Pamela A. Harbeson, Esq. is Chair of the MCLE's "The Means Test & Other Common Consumer Bankruptcy Minefields" to educate practitioners on the nuances of the "Means Test" and providing key practice pointers.
The faculty will cover what
constitutes current monthly income, what comprises household size, whether a debtor can deduct secured creditor payments when s/he intends to surrender the property, what is disposable monthly income for a Chapter 13 debtor, how long does a Chapter 13 plan have to be, and what constitutes "abuse" under the Means Test. The program concludes with a practical guide to avoiding some common minefields of consumer bankruptcy law-homestead issues, avoidable transfers, and how divorce plays into a bankruptcy case-to name just a few.
