Bankruptcy – Business and Individual
Our Bankruptcy and Insolvency attorneys adeptly handle a broad variety of bankruptcy matters. We represent both individual and business debtors in Chapter 7 (straight bankruptcy), Chapter 13 (wage earner bankruptcy) and Chapter 11 (corporate reorganization). For individuals, we guide the debtor through the bankruptcy process, advising the debtor on the most appropriate bankruptcy chapter, how to protect assets and how to develop a strategy for obtaining a discharge. For businesses, we work closely with the business management team to develop a viable business plan, to negotiate with secured lenders and other creditors to obtain confirmation of the debtor’s plan of reorganization and to navigate the complexities of business restructuring and bankruptcy process. We have broad experience representing trustees, trade creditors, landlords, secured creditors and lenders in connection with financial restructurings, claims recovery and protecting and enforcing rights.

Our Bankruptcy and Insolvency Practice Group has an impressive range of experience in assisting individual and corporate clients in financial restructuring or liquidation outside of bankruptcy. Our attorneys have represented clients in a wide variety of industries, including, retail, recreation, hi-tech, construction, real estate, biotech and manufacturing. We work closely with management to choose a restructuring or liquidation method that best suits the client’s ultimate goals. These methods include receiverships, assignments for the benefit of creditors, creditor trusts, creditor compositions and the orderly liquidation of business or personal assets.

Commercial and Bankruptcy Litigation
Looney & Grossman’s business law acumen and first-rate bankruptcy, trial and appellate expertise place us in a unique position to provide clients with excellent and cost-effective representation in bankruptcy and commercial litigation disputes. We have knowledge and skill in numerous areas of law, including contract, real estate, personal property, Uniform Commercial Code, insurance and other litigation matters that arise out of or in connection with bankruptcy and insolvency matters. Our attorneys also have extensive expertise in prosecuting and defending fraudulent and preferential transfer cases in bankruptcy court.

Financial Planning and Asset Protection
Drawing on the depth of experience of its bankruptcy law practice, our Bankruptcy and Insolvency Practice Group assists clients with developing appropriate strategies to protect assets and to minimize exposure to liabilities. We advise clients on whether to utilize asset protection techniques such as trusts, gifts, exemptions, and transfers, and we help clients identify when assets cannot be protected and whether transfers or gifts may constitute preferential or fraudulent transfers.

Acquisition of Claims
Our Bankruptcy and Insolvency Practice Group represents clients who purchase bankruptcy claims for investment, assisting them in identifying and evaluating cases and claims of potential value. We help clients develop a negotiating strategy, prepare solicitation materials, close deals, and file appropriate notification materials with the bankruptcy court.
